Terms of Service Agreement

Please read the following Terms of Service Agreement (“TOS”) carefully. By accessing or using our sites and services, you agree to be bound by the terms and all terms incorporated herein by reference. If you do not agree to all the terms and conditions, do not access or use our sites or services.

Acceptance of Terms

This is a legally binding agreement between users and Drive Smart Driving School (“Drive Smart”), TDLE LICENSE NUMBERS C2830 and C2830A, regarding use of our websites: drivingschoolcarrollton.com, texassmartdrivers.com, and drivingschoolsofnorthtexas.com (the “Sites”) and all services (the “Services”).

Description of Website Services Offered

Drive Smart provides class schedules and allows enrollment and payment via PayPal. All users, whether registered or not, agree to abide by this TOS. Registered users are referred to as “members.”

Users acknowledge that our services, content, and applications are the property of Drive Smart. We may update, revise, or discontinue services at our discretion and without liability.

Services are provided “AS IS” and Drive Smart is not liable for delays, missed delivery, deletion, or storage failures.

Registration

To register, you must be at least 18 years old and provide accurate and complete information. Providing false or incomplete information may result in suspension or termination of your account.

Account Security

You are responsible for keeping your password secure. Notify Drive Smart immediately if you suspect unauthorized use. Drive Smart is not responsible for losses resulting from your failure to maintain confidentiality.

Conduct

You agree not to use our services for illegal or harmful purposes, including but not limited to harassment, impersonation, infringement, or distributing viruses or spam.

Drive Smart reserves the right to remove content or terminate access for violations of this TOS or applicable laws.

Global Use & Export Compliance

Users agree to comply with U.S. export and import laws and not to use our services for prohibited purposes under federal law.

User Content

You retain ownership of submitted content, but grant Drive Smart a license to use, display, and distribute it as part of our services.

Contributions

Feedback and suggestions submitted to Drive Smart become our property. We may use or publish contributions without compensation.

Indemnification

You agree to hold Drive Smart harmless from claims or legal demands arising from your content, service use, or violations of the TOS.

Service Use

Commercial exploitation of the site is prohibited. Drive Smart may set limits on service usage and delete inactive accounts.

Modifications

We may modify or discontinue services at any time. Continued use constitutes acceptance of those changes.

Termination

Accounts may be terminated for violations, inactivity, nonpayment, or legal requests. Termination includes deletion of access and data.

Advertisers & Links

Drive Smart is not responsible for third-party content or transactions made through external links or advertisements.

Proprietary Rights

Content and software are protected by copyright and other laws. Users may not copy, modify, or reverse engineer our software or services.

Disclaimer of Warranties

Services are provided “as is” without warranties of any kind. Drive Smart disclaims liability for accuracy, reliability, or uninterrupted access.

Limitation of Liability

Drive Smart is not liable for indirect, incidental, or consequential damages related to your use of the services.

Governing Law

This agreement is governed by Texas law. All disputes must be resolved in Denton County, Texas courts or the U.S. District Court in that jurisdiction.

Miscellaneous

• Waiver of any provision does not waive future enforcement.
• If any part is invalid, the rest remains enforceable.
• Your account is non-transferable and terminates upon death.
• Any legal claims must be brought within one (1) year of the event.
